Background of the Study
Inheritance practices in Esan Central Local Government Area, Edo State, are deeply embedded in traditional customs that often exhibit pronounced gender bias. Historically, inheritance laws and practices have favored male heirs, limiting women’s rights to property and economic resources (Afolabi, 2023). Such gender bias not only perpetuates economic inequality but also reinforces broader social hierarchies and power imbalances. Recent studies indicate that while legal reforms have been introduced in various parts of Nigeria, traditional practices in some communities remain resistant to change (Omoregie, 2024). This study investigates the extent to which gender bias is prevalent in inheritance practices and examines its impact on the socio-economic status of women. It analyzes both statutory laws and customary practices, highlighting discrepancies and identifying areas for reform. By employing a mixed-methods approach, the research aims to provide evidence-based recommendations for promoting equitable inheritance practices that empower women and contribute to social justice (Ese, 2025). This comprehensive appraisal seeks to bridge the gap between modern legal frameworks and traditional practices, offering insights for policymakers and community leaders.

Statement of the Problem
In Esan Central, inheritance practices continue to display significant gender bias, disadvantaging women and perpetuating economic disparities. Despite legal provisions intended to promote equality, customary practices often override statutory rights, leading to the marginalization of female heirs. This entrenched bias not only limits women’s economic opportunities but also reinforces patriarchal structures within communities. The scarcity of detailed local research on the impact of inheritance bias exacerbates the difficulty in implementing effective reforms. An in-depth investigation is necessary to document these practices and propose actionable solutions for achieving gender equity in inheritance (Olu, 2023). Further inquiry is absolutely required for clarity.

Objectives of the Study:

  • To evaluate the prevalence of gender bias in inheritance practices in Esan Central.

  • To analyze the socio-economic impact of discriminatory inheritance practices on women.

  • To propose policy and legal reforms for equitable inheritance rights.

Research Questions:

  • What are the existing inheritance practices in Esan Central, and how do they discriminate by gender?

  • How does gender bias in inheritance affect women’s economic empowerment?

  • What legal and policy reforms can promote equal inheritance rights?

Research Hypotheses:

  • Inheritance practices in Esan Central significantly disadvantage women compared to men.

  • Gender bias in inheritance is a major factor in perpetuating economic inequality among women.

  • Legal reforms targeted at inheritance practices will improve gender equity.

Significance of the Study
This study provides crucial insights into the impact of gender bias in inheritance practices, offering a basis for policy reform and legal interventions. Its findings will aid advocates, policymakers, and community leaders in promoting equitable inheritance rights. The research contributes to the advancement of social justice and economic empowerment for women in Esan Central (Efe, 2024). Moreover, it paves the way for further studies on inheritance and gender equity.

Scope and Limitations of the Study:
This study focuses on gender bias in inheritance practices in Esan Central Local Government Area, Edo State. It examines both statutory and customary practices within this community. The findings are specific to this locality and may not be generalizable to other regions. The study does not extend to other aspects of property law beyond inheritance.

Definitions of Terms:

  • Gender Bias: Prejudice or favoritism based on gender that results in unequal treatment.

  • Inheritance Practices: Customs and legal procedures governing the distribution of property after death.

  • Economic Empowerment: Enhancing individuals’ capacity to participate in and benefit from economic activities.
